TERMS OF SERVICE

3 Eggs Design (‘we,’ ‘us,’ ‘our,’ ‘I’, ‘Three Eggs Design’) provides certain services to you through its website located at www.3eggsdesign.com.au (the ‘Site’). By visiting our site, you agree and accept the terms set forth in this policy. 3 Eggs Design cannot and will not be liable for any loss or damage arising from your failure to comply with any provision of our Terms of Service. We may periodically update this policy without specific notice to you.

The Service
3 Eggs Design provides customised printable digital files and digital instant downloads for event invitations and paper goods (‘Stationery,’ ‘Printable,’ ‘Template,’ ‘PDF’ or ‘Card’).

Conditions of Use
You are solely responsible for all text copy and photographs that you provide to us and that it will not infringe, misappropriate, use or disclose without authorisation, or violate any copyright, trade secret right or other intellectual property or property right of any third party. All designs belong to 3 Eggs Design. Unless otherwise specified, you agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or transmit for any commercial purposes without the prior written permission from 3 Eggs Design. All templates are for personal use only. The designs are the intellectual properties of 3 Eggs Design and are protected by copyright. By using our templates, you agree to be bound by our terms. If you do not agree to our terms, do not purchase or use our templates.

Payments & Sales Tax 
Payment is required up front. Design will commence once all wordings are received. All prices are in AUD.

3 Eggs Design is not responsible for custom fees, taxes or other costs that you may be required to pay in your home country. Nor are we responsible for delays at your customs or postal office. Once the package enters your country, any delivery issue is out of our control.

Proofs
Please carefully review the digital proof. Once it is approved, we will set the artwork up for print. Due to the personalised nature of the product, we are unable to accept returns as time is spent on adjusting the design, layout, colour, sizing and spacing. We encourage you to do a test print to assure you are happy with the design, colour and text before the final printed files are sent to you as colours can vary from screen to screen and printer to printer. Inclusive of the price (excluding favour tags, signs, posters, table cards and name cards) you will receive one complimentary proof to allow minor text or colour changes. Please note this does not include changes to the overall design. Additional proofs will incur a fee per card.

The Product – PDF Digital Files 
3 Eggs Design’s digital files are designed for home printing and will work at most local copy centres. Our files are non-editable and password protected, preventing any editing of artwork in programs such as Adobe Illustrator. Our files may not be compatible with all software used by printers, so we cannot guarantee our PDF file will work at all print houses. Please contact us to arrange for an alternative file(s).

Refunds
Purchases of 3 Eggs Design digital product(s) are non refundable unless artwork has not commenced or been sent to your email address. All digital instant downloads are non refundable. 

3 Eggs Design has a 14 days refund policy on printed goods. Only our regular priced items are eligible for refunds and sale items can't be refunded.

PRIVACY STATEMENT

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing: With your permission, we may send you emails about our store, new products and other updates.

SECTION 2 - CONSENT

How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card or place an order, we imply that you consent to our collecting this data and opting in to receive our newsletter. This is set as a default when you purchase from us. To change this, just untick the box at checkout, click 'Unsubscribe' from any email from us, or follow the step below.

How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at hello@3eggsdesign.com

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 - COOKIES

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.
_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

SECTION 8 - ANALYTICS

Our website uses Google Analytics, a service which transmits website traffic data to Google servers in the United States. Google Analytics does not identify individual users or associate your IP address with any other data held by Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information. We use reports provided by Google Analytics to help us understand website traffic and webpage usage.

By using this website, you consent to the processing of data about you by Google in the manner described in Google's Privacy Policy and for the purposes set out above. You can opt out of Google Analytics if you disable or refuse the cookie, disable JavaScript, or use the opt-out service provided by Google.

Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use (http://www.google.com.au/analytics/terms/us.html) and the Google Privacy Policy (http://www.google.com/policies/privacy/).

We also uses interfaces with social media sites such as Facebook, LinkedIn, Twitter and others. If you choose to "like" or "share" information from this website through these services, you should review the privacy policy of that service. If you are a member of a social media site, the interfaces may allow the social media site to connect your visits to this site with other Personal Information.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
